NOTES: Response the same day. Email to Ron Panzer, 3/25/14, asking for his thoughts on this bill. well, the first thing is they reduced the penalty for violating the law from 1,000 to 250 which means the penalties are meaningless and the facilities can violate the law with impunity, i.e., the “cost of doing business.” They eliminated the inclusion of family of residents on the council. Further, they seem to have previously limited the items which this council can decide upon. They eliminated a provision that said they have to provide the law in written form to the residents, which again, works to deprive the patients of their rights and keep them uninformed or misinformed of their rights. They are moving toward a “written reply” and written communications from the council. It almost sounds as if they are eliminating the requirement to respond to the residents’ verbal communications. And giving 14 days to respond gives more room for the facility to continue to violate the wishes of the residents, perhaps making the council’s recommendations moot. They also require the recommendations to be in written form rather than just verbal. That’s a protection for the staff. They want the placement of a staff member on the council, requiring some member of staff to be diverted from his/her duty. A lot of damage or harm can be accomplished in 14 days. Perhaps troublesome residents themselves could be eliminated or removed from the facility within that 14 days. Speak up and …. ? These are not good changes and none of them seem to strengthen the rights of the residents. Panzer says that resident councils are a normal and a good thing if used properly.
