Response the same day. Email to Ron Panzer, 3/25/14, asking for his thoughts on this bill. well, the first thing is they reduced the penalty for violating the law from 1,000 to 250 which means the penalties are meaningless and the facilities can violate the law with impunity, i.e., the “cost of doing business.” They eliminated the inclusion of family of residents on the council. Further, they seem to have previously limited the items which this council can decide upon. They eliminated a provision that said they have to provide the law in written form to the residents, which again, works to deprive the patients of their rights and keep them uninformed or misinformed of their rights. They are moving toward a “written reply” and written communications from the council. It almost sounds as if they are eliminating the requirement to respond to the residents’ verbal communications. And giving 14 days to respond gives more room for the facility to continue to violate the wishes of the residents, perhaps making the council’s recommendations moot. They also require the recommendations to be in written form rather than just verbal. That’s a protection for the staff. They want the placement of a staff member on the council, requiring some member of staff to be diverted from his/her duty. A lot of damage or harm can be accomplished in 14 days. Perhaps troublesome residents themselves could be eliminated or removed from the facility within that 14 days. Speak up and …. ? These are not good changes and none of them seem to strengthen the rights of the residents. Panzer says that resident councils are a normal and a good thing if used properly.

Susan Eggman, (D) 916-319-2013. End-Of-Life Care: Patient Notification. So far, a very vague bill. Makes a serious change in the 2008 End-of-Life legislation that only allowed distribution of POLST and other life-ending forms, when patient asked for it. This requires a health care provider to put a form into the hands of a diagnosed terminally ill patient. It needs a definition of who qualifies as a person to make this diagnosis and then hand out medical directive forms.

Medi-Cal: Estate Recovery
Health | |
Hernandez E (D) | |
Ed Hernandez, (D) Medical: Estate Recovery. The state is currently authorized to claim a certain amount of the property of a medical recipient and or heirs to repay the cost of services. This bill would change that requirement while still being allowed to make certain claims against a patient’s holdings. Bill was gutted and amended into current wording.

Lois Wolk (D-Napa) 916-323-2304. Creates a statewide POLST registry and authories the charging of a fee for registering to cover costs of operating the registry. Also authorizes dissemination of information to authorized personnel. Needs clarification to reference of a legally recognized health care decisionmaker.~~~ Perhaps is expansion of authority of lower-eschelon health care workers to make life changing decisions for the patient.
